Current Abortion Laws in Indiana

Abortion is largely prohibited in Indiana. It is only permitted in very limited cases:

  • To save the life or protect the serious health of the mother
  • If the fetus has a lethal anomaly
  • In cases of rape or incest, but only up to 10 weeks post-fertilization

Indiana law also prohibits abortion through telemedicine, and the abortion pill cannot be legally mailed. Abortions must be performed in a hospital or hospital-affiliated outpatient facility and only under the specific exceptions outlined above.


Ectopic pregnancies are not considered abortions under Indiana law. Treatment for an ectopic pregnancy, where the pregnancy develops outside the uterus and cannot survive, is fully legal and available. This care is essential and is not restricted by abortion regulations.


Miscarriage Care Is Not the Same as Abortion Care

It’s important to understand that Indiana abortion laws do not restrict access to medical care for miscarriage. A miscarriage—also known as spontaneous pregnancy loss—is medically and legally distinct from abortion. Hospitals and providers are fully permitted to provide necessary miscarriage care.
